Additional Payment Options


(1)Arbitration Commencement Fees

The non-refundable commencement fee is due with the Notice to Arbitrate or the Application to Mediate filed with the BCICAC.

Additional commencement fees are due with the filing of a claim in excess of the amount stated in the Notice of Request for Arbitration/Mediation, an additional claim, and a counterclaim filed with the BCICAC.

Where an amount in dispute cannot be stated, the Centre shall have discretion to set a fee.  In such cases the commencement fee shall generally be not less than $1,500 for an Arbitration and $750 for a Mediation (plus 12% HST).

(2)Arbitration Administrative Fees

The BCICAC will invoice the administration fee quarterly beginning six months after the commencement date.  The administration fee will be assessed on the basis of the highest claim or counterclaim value.

The above fees apply where the Centre acts as administrator and appointing authority pursuant to the Rules of the BCICAC or the UNCITRAL Rules. The fee for the BCICAC to act as the appointing authority only is $1,000 (plus 12% HST)

(3)Disbursement Fees

The above fees do not include expenses incurred by the BCICAC in its administration of an arbitration/mediation case.  The BCICAC may invoice for expenses on an interim basis as it deems appropriate.

Liability for fees and expenses is joint and several between the parties to the arbitration.  Where a party does not pay an administration fee or other outstanding amount due to the BCICAC, any other party may pay that amount to ensure that the arbitration proceeds.  If payments are not made, the tribunal may order the suspension or termination of the proceedings.

Fees are governed by Rule 4 of the BCICAC Domestic Commercial Arbitration Rules of Procedures.

All fees and disbursements due to the BCICAC
shall be paid prior to release of the final award.

Arbitrator/Mediator Fees

The above fees do not include the fees and expenses of an arbitrator(s)/mediator. Hourly rates are set by individual arbitrators/mediators.

(4)Domain Name Dispute (CIRA) Fees

The addition the following Panel Fees will apply for all Domain Name Dispute (Canadian Internet Registration Authority – CIRA) Cases:

(5)Mediation Cancellation Fees

If mediation is cancelled less than 5 working days prior to mediation date, the canceling party will be responsible for the full share of the mediation fee. If mediation is postponed less than 5 working days prior to the mediation date and is re-scheduled within 14 days, the parties will pay a re-scheduling fee of $200 per party (plus 12% HST).

If a mediation settles less than 5 working days prior to the mediation date, each side will pay $200 (plus 12% HST) cancellation fee. (Note: this is in addition to the applicable initial application fee).

If the mediation is cancelled for any reason within the last 24 hours before the scheduled commencement of the conference, the full fee is due and payable.
